Ex-NSA Employee Admits Guilt in Taking Home Classified Files

Unidentified officials from the USA government, who could only speak about the classified details on the condition they remain anonymous, said that Pho took the classified documents home with him to help him rewrite his resume, the Times reported. According to a court document, from 2010 to March 2015, Pho removed classified material in hard copy and digital form.

According to anonymous sources from the investigation who spoke with New York Times reporters, Pho is the NSA employee at the heart of the recent Kaspersky saga.

Federal prosecutors said they will seek an eight-year sentence for Nghia Hoang Pho, 67, of Ellicott City, Maryland, for willful detention of classified information.

"In connection with his employment, Pho held various security clearances and had access to national defense and classified information".

Pho faces a maximum of 10 years in prison.

The Department of Homeland Security in September ordered federal agencies to start removing Kaspersky software from their computers.

US District Judge George L. Russell scheduled sentencing for April 6. U.S. officials have said the firm either has ties to Russian intelligence or is forced to share information held on its servers with Russian officials.

Kaspersky has acknowledged that its software lifted hacking tools from a home computer in 2014, but said it was not part of an intentional effort to steal information from the NSA. It is further alleged by U.S. government sources that Russian spies were able to get their hands on the top-secret code via the antivirus package, although Kaspersky denies any direct involvement. Most notably, former NSA contractor Edward Snowden disclosed a cache of classified material in 2013 exposing US government surveillance programs.

The court documents don't mention it, but Pho appears to be the NSA employee at the heart of the spying accusations swirling around the Moscow-based security firm Kaspersky Lab.

Pho is at least the third NSA employee or contractor to be charged within the past two years on counts of improperly taking classified information from the agency, breaches that have prompted criticism of the secretive NSA.

The agency's loss of control over its sensitive hacking tools has caused great concern at its Fort Meade headquarters, at the Pentagon and in Congress.

In June another NSA contractor, Reality Winner, 25, was charged with leaking classified material about Russian interference in the 2016 United States presidential election to a news outlet. Harold Martin, an NSA contractor, was indicted in February for stealing up to 50 terabytes of data during a 20 year period, The Times said. She pleaded not guilty.
