He was accused of knowingly providing the Environmental Protection Agency with false information about engine computers in more than 500,000 of Volkswagen's diesel vehicles, which investigations found were purposefully programmed to hide unlawful emissions performance. He had pleaded guilty in August to charges he conspired to commit fraud and violate the US Clean Air Act.

In August, Oliver Schmidt pled guilty to federal charges of conspiring to defraud the USA and violating the Clean Air Act in connection with Volkswagen's "clean diesel" emissions cheating scandal. "It is my opinion that you are a key conspirator in this scheme to defraud the United States", Cox told Schmidt in court.

Schmidt, as the general manager of Volkswagen's Engineering and Environmental Office in MI, was responsible for the company's relationship with California's regulatory agency and as per the reports, fed federal regulators with incorrect information. The government says he later misled USA investigators and destroyed documents.

Schmidt read a written statement in court acknowledging his guilt and broke down when discussing his family's sacrifices on his behalf since his arrest in January.

In arguing for a seven-year sentence, prosecutors last month said Schmidt had participated in "one of the largest corporate fraud schemes in American history" and led efforts to cover up the company's misconduct in the summer of 2015.

Liang and Schmidt are among eight VW executives criminally charged for their alleged roles in the scheme.

In March, Volkswagen AG pleaded guilty to three felonies and agreed to pay a $2.8 billion criminal fine.

He is the highest-ranking VW employee to be convicted in the scheme in the United States and the chances that the U.S. authorities will prosecute more senior VW executives are slim as most are in Germany, which is unlikely to extradite its citizens to stand trial in the US.
