United States finalizes hefty duties in Bombardier-Boeing trade case

"Boeing is using its meritless complaint as cover to close the USA market, which is one of the biggest in the world, to new entrants such as Bombardier's C Series aircraft", Turner said.

In response to the complaints, the U.S. Department of Commerce levied duties of close to 300% on Bombardier's aircrafts.

Boeing, which launched the trade case in April, is arguing that Canadian and British governments are subsidizing the plane's cost, allowing Bombardier to sell into the USA market at unfairly low prices. That decision is due by February 1.

Bombardier criticised the near-300% duties, saying its plan of partnering with the European company Airbus to launch the CSeries assembly from a production line in Mobile, Alabama, would make it an American company.

The plan would create a new wrinkle because the planes would effectively be a USA product."There's no case here", Bombardier's Bellemare said, calling the complaint "ridiculous".

"The Government of Canada is deeply troubled by the protectionist nature of Boeing's allegations, which seek to advance its market dominance by excluding Bombardier's C Series aircraft from the US market", Freehand said.

The Commerce Department's decision comes as the Trump Administration takes a hard line on trade practices it views as hurting American workers.

The U.S. International Trade Commission is expected to make a determination if Boeing was harmed by Bombardier's actions, a decision that will determine whether the investigation will be terminated. The trade dispute stems from a complaint by US aerospace giant Boeing against its Canadian rival that found a receptive ear in President Donald Trump, whose "America First" agenda has included taking a tough line in matters of worldwide commerce. It includes a 79.82% tariff to offset a Commerce Department ruling that Bombardier engaged in price dumping, meaning it sold the CS100s to Delta below its fair market value by that amount. Bombardier calls Boeing's criticism unfounded, saying that the USA company's entire case has been overtaken by events. Bombardier and Boeing argued their cases Monday before the ITC, an independent, quasi-judicial USA agency.

The question now before the ITC is whether those improper benefits injured Boeing in the 100-150-seat market for commercial aircraft.

"Tariffs on the scale proposed by the US Commerce Department in the world's largest airline market, threaten to undermine the long-term economics of Bombardier's presence in Northern Ireland".

The partnership with Airbus means there is "no chance Boeing will be harmed by imports", said Mike Nadolski, vice president of public affairs at Bombardier.
