France to set the legal age for sexual consent at 15

It is worth noting that this is, in some ways, merely an extension of existing French law; under current regulations, an adult who performs a sexual act with someone younger than fifteen can be charged with a sexual offense. The move by France follows advice from doctors and legal experts.

After public consultations and the recommendation of a panel of experts, "the government has made a decision to set the age at 15", Schiappa told AFP.

But prosecutors hoping to charge an offender with rape must prove the sex was forced, a more complicated question when pre-teens are involved.

As The New York Times explains, "In France, as long as "violence, coercion, threat or surprise" is not proven, sexual intercourse with a minor - even one under 15 - is considered an atteinte sexuelle, which is an infraction and not a crime".

Speaking previously Schiappa said: "The law will mean that "below a certain age, there can be no debate, ever, on the sexual consent of a child, and that any child below a certain age would automatically be considered as raped or sexually assaulted".

"The Bill will contain a clause stating an age limit below which it will always be deemed that a child was forced", Schiappa said, supporting the reform.

The issue of consent was brought to the spotlight after critics and lawmakers said French laws had allowed two adult men to escape charges after they were accused of sex with underage girls.

But the same court reversed its decision last month, saying the accused should face rape charges.

When in effect, the law will criminalize all sexual activity with a minor younger than 15.

Officials had previously mulled setting the age at 13, but some, including President Emmanuel Macron, had argued for it to be older.

The new age limit is set to be approved by the government in a couple of weeks as part of package of other laws against sexual violence and harassment after discussing whether to set the age as 13 or 15, which is what groups fighting violence against children had campaigned for.
