Attorney Michael Avenatti released the the non-disclosure agreement Tuesday as he filed a complaint against Trump in a California state court, claiming it was not in effect because Trump never signed it and claiming Cohen violated the agreement by revealing its existence.

"To be clear, the attempts to intimidate Ms. Clifford into silence and "shut her up" in order to 'protect Mr. Trump" continue unabated, ' according to the suit.

The documents also state Trump used the alias David Dennison (or "DD"), but because Trump did not sign the NDA, Avenatti argues the agreement is now "legally null and void and of no outcome". "The extent of Mr. Trump's involvement is these efforts is presently unknown, but it strains credibility to conclude that Mr. Cohen is acting on his own accord without the express approval and knowledge of his client Mr. Trump".

Guthrie also directly asked Avenatti if Trump had sex with Daniels, which the lawyer simply replied, "yes".

Previously, through a lawyer, Clifford denied the two had an affair, but Avenatti said Wednesday that was to meet the terms of the nondisclosure agreement.

The nondisclosure agreement used the aliases David Dennison and DD to refer to Trump, and Peggy Peterson and PP to refer to Daniels.

In an interview on "CBS This Morning" Daniels' new attorney, Michael Avenatti, said that Clifford will "absolutely not" be seeking to profit from her story but then qualified his initial assertion by saying, "I don't know whether she's gonna ultimately seek payment or not".

Stormy Daniels, whose real name is Stephanie Clifford, filed a lawsuit in Los Angeles County Superior Court on Tuesday.

The lawsuit says that as recently as February 27, Cohen began "a bogus arbitration proceeding" against Daniels in Los Angeles to keep her quiet.

"She believes it's important that the public learn the truth about what happened", he said. Among the more salacious details of her claim was that she spanked Trump on his butt with a rolled up copy of Forbes magazine, During this time Melania Trump had recently given birth to Barron Trump.

The first option would involve Trump defending himself against Daniels' action.

The suit says "it was widely understood at all times" that all parties had to sign the agreement, otherwise it would be null and void.

The president has never addressed the alleged relationship with Clifford publicly, and the White House has side-stepped questions about it with spokesperson Raj Shah telling members of the press he had never asked the president about the alleged relationship.

In October 2016, she accepted $130,000 from Mr. Trump's longtime attorney Michael Cohen in exchange for her silence about the alleged relationship, according to the filing.
