President Trump's personal attorney Michael Cohen under criminal investigation, DOJ says

Cohen's attorneys have filed a temporary restraining order in the matter, asking the court to stop federal prosecutors from using some of the records they seized.

In response to Cohen's motion to prevent prosecutors from using evidence collected in Monday's raids of his home and office, the U.S. attorney in NY asserted the raids were authorized by a federal judge to seek evidence of conduct "for which Cohen is under criminal investigation". "They remained unsure what had been taken, an uncertainty that has heightened the unease around Mr. Trump". According to the Times, Trump called Cohen on Friday to "check in", which is probably not wise for a president to do when it involves an associate under federal investigation - especially if that president's associate has a habit of recording conversations.

Federal investigators in NY are looking into years' worth of Cohen's business dealings, as well as lawyering he did for Trump as his longtime personal attorney, fixer, and confidant. Cohen admitted to paying adult film actress Stormy Daniels $130,000 in October 2016 for her silence about a sexual encounter with Trump in 2006.

"Although Cohen is an attorney, he also has several other business interests and sources of income".

After hearing the matter Friday, U.S. District Court Judge Kimba Wood said she did not have enough information to issue any ruling on that request.

Cohen's lawyers apparently want to go over the documents and tapes and shield from prosecutors any they deem privileged. "It might be less than a thousand".

Assistant US Attorney Tom McKay said the law was very clear that the privilege "can't be used as both a sword and a shield".

McDougal alleges in a lawsuit that Cohen has a cozy relationship with Davidson.

But Cohen has presented no evidence that he was in Los Angeles at the time in question, and his claim that he's "never been to Prague" directly contradicts his previous public statements.

Cohen denied that he'd ever been to Prague "in my life" after the dossier's publication, tweeting a photo of his passport.

Just because the prosecution appears to believe Trump and Cohen are co-conspirators, that doesn't necessarily mean that will be proven, but that scenario is "clearly being scrutinized", McCarthy said. A judge granted that request late Friday. When he introduced himself to the judge to ask to be heard, Wood seemed to indicate that she was already aware of his identity.

In any case, as previously reported, all seized materials are subject to review by a special "taint team" (make your own joke) to make sure they're not protected.

The search warrant also sought evidence of whether the lawyer, Michael D. Cohen, tried to suppress damaging information about Mr. Trump during the 2016 presidential campaign.
