Colorado baker Jack Phillips says he's ready to make wedding cakes again

Colorado baker Jack Phillips says he's ready to make wedding cakes again

The case hinged on whether a bakery owner could refuse to sell a wedding cake to a gay couple, and the court ruled in the baker's favor largely because of how Colorado authorities had addressed his legal claims.

Colorado baker Jack Phillips - the central figure in the Supreme Court ruling Monday- says he doesn't discriminate against anyone.

In other words, Phillips's religious beliefs about marriage-beliefs, by the way, which are orthodox teachings in Christianity, Judaism, and Islam-are not to be taken seriously.

Gay rights groups feared a ruling against the couple could set a precedent for treating gay marriages differently from heterosexual unions.

"This cake is a specific cake", Phillips explained.

In a move welcomed by the Australian Christian Lobby, NSW upper house MP Fred Nile last week introduced a private member's bill into State Parliament that would allow bakers, florists, motels and even lawyers and accountants to refuse to provide goods or services in connection with a same-sex marriage.

The litigation, along with similar cases around the country, is part of a conservative Christian backlash to the Supreme Court's gay marriage ruling.

"The supreme court ruling indicates that the government must not treat Jack Phillips with hostility because of his religious beliefs", said Stephani Liesmaki, a spokesperson for MNFC.

"It said that the government can not express religious hostility and that there's no place for that kind of hostility in a pluralistic society", she said.

"The commission's hostility was inconsistent with the First Amendment's guarantee that our laws be applied in a manner that is neutral toward religion", Kennedy wrote, referring to the First Amendment of the U.S. Constitution.

"Freedom of religion and religion has been used to justify all kinds of discrimination throughout history, whether it be slavery, whether it be the holocaust". The cake requested was not a special 'cake celebrating same-sex marriage.' It was simply a wedding cake-one that (like other standard wedding cakes) is suitable for use at same-sex and opposite-sex weddings alike...

Both Carter and Witt said Monday's decision will not stop their continued fight for equal rights.

George Hefner was one of the many people who came to Masterpiece Cakeshop to congratulate Phillips.

The couple would eventually file a discrimination complaint against the shop, which was upheld until Phillips appealed it to the nation's highest court.

How did the legal action start?

"This has been going on for six years and to have it turn out this way was very disappointing", Dave Mullins told CNN's John Berman on "New Day".

Kennedy noted that the commission had ruled the opposite way in three cases brought against bakers in which the business owners refused to bake cakes containing messages that demeaned gay people or same-sex marriage.

Forcing such participation, argues Justice Clarence Thomas in an separate opinion joined by Gorsuch, is a violation of Phillips's First Amendment rights because it would force him to "affirm a belief with which he disagrees".

Which Justices disagreed with the ruling? Justices Ruth Bader Ginsburg and Sonia Sotomayor were the only dissenters.

The couple, David Mullins and Charlie Craig, were married in MA but held a celebration with friends and relatives in Colorado when they returned.

"These disputes must be resolved with tolerance, without undue disrespect to honest religious beliefs, and without subjecting gay persons to indignities when they seek goods and services in an open market", he wrote. In other words, if the commission had acted neutrally but reached the same conclusion, he may have ruled against the baker.

Is this an issue elsewhere?

. "They won't realize, because they will not have scratched the surface of the opinion, that that's not in fact what the Supreme Court has said here today".
