South Africa Has Legalised Cannabis Use For Adults In Private Places

In a unanimous judgment by the Constitutional Court's Deputy Chief Justice Raymond Zondo, he was careful to refer to the use and cultivation of dagga "in private".

The ruling saw pro-marijuana activists in the court's public gallery breaking into chants of "Weed are free now".

Here are the details.

It has not yet commented on the ruling, which is binding.

However, the judgement did not specify the amount that can be used by an adult in private use.

The most important thing was to get the police to back away from harassing people using cannabis, he said. It will remain illegal to sell dagga in any form, and public use will remain prohibited as well.

The judgement did not say how much cannabis one may have at home for private use.

Already there's concern in some quarters that driving under the influence, as governed by Section 65 of the National Road Traffic Act, may not treat dagga users the same.

In the meantime‚ the court specified it has granted interim relief that allows personal use at home.

The Western Cape High Court has previously found provisions in the Drug Act unjustifiably limited the applicants' rights to privacy.

However, he's acknowledged that it will be hard for police to determine who is contravening the law and who is not.

The top court ruled an adult can cultivate cannabis in "a private place" as long as it is for personal consumption in private.

Every year, thousands of South Africans march on the streets of Cape Town demanding a relaxation of drugs laws to allow medicinal and recreational use of cannabis.

Zondo said that this reading-in will apply until such time as Parliament fixes the Constitutional defect in the case.

They also cite medical research which suggests a link between heavy use of marijuana and psychotic disorders such as schizophrenia.
